Warning! If you are using an non Chinese Network as a Services Provider to deliver services between China and rest of world, you might be violating Chinese Law.


According to the latest update from China Academy of Information and Communications Technology (CAICT), an institute directly under the Ministry of Industry and Information Technology (MIIT) of China, that without the approval of the MIIT, no entity or individual may set up or rent a network private IP VPN (e.g. MPLS, SD-WAN) to carry out cross-border business activities. Enterprises network infrastructure provider must ensure your Chinese Network Services Provider has obtained the necessary licenses, otherwise you might be breaking Chinese rule, which could impact your business operation in China.


For Domestic Private IP VPN service, network services provider must obtain MIIT Telecom License (B13) For Domestic Layer 2 VPN services (e.g. Ethernet Private Line) network services provider must obtain MIIT Telecom License (A24-1) For International Cross Border services, network services provider must obtain MIIT Telecom License (A14-1 Cross Border VPN and A14-4 Cross Border Data Transfer), as presence only the 3 state own telco has been granted with the (A14-1 and A14-4) license.
